Terms of Service

1. About these terms

These terms of service (“Terms”) govern your use of the Arqor platform and Arqor SiteRecord application (together, the “Service”), operated by Damon Randall trading as Darkstar Design (“we”, “us”, “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Arqor SiteRecord is a construction site photo logging application that enables contractors and builders to capture, organise, and share timestamped and GPS-tagged photographic records of construction work. The Service includes web and mobile browser access, photo storage, floor plan uploads, trade QR access, share links, and PDF report generation.

The Service is provided as a software-as-a-service (SaaS) product. We may update, modify, or improve the Service from time to time without prior notice.

3. Accounts and eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By creating an account on behalf of a business, you represent that you have authority to bind that business to these Terms.

You are responsible for maintaining the security of your account. We authenticate users via email-based magic links. You must not share your login links with others.

Trade users who access the Service via QR code scanning do not require an account and are not bound by billing obligations, but their use of the Service is subject to these Terms.

4. Free trial and billing

New users receive a 14-day free trial of the Service. The trial period begins when you create your first job within the application. A valid payment method is required at signup but will not be charged until the trial period ends.

After the trial period, your payment method will be automatically charged the applicable subscription fee (currently £45 per month for Founding Members). Subscriptions renew monthly on the anniversary of your first payment.

You may cancel your subscription at any time through the billing settings in the application or by contacting us. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

We reserve the right to change pricing for new subscribers. Founding Member pricing is locked at the rate in effect at the time of your initial subscription and will not increase for the duration of your continuous subscription.

5. Your data and content

You retain all ownership rights to the photos, floor plans, documents, and other content you upload to the Service (“Your Content”). By uploading content, you grant us a limited licence to store, process, display, and transmit Your Content solely for the purpose of providing the Service to you.

We do not claim ownership of Your Content. We will not sell, share, or use Your Content for any purpose other than providing the Service, except as required by law.

You are solely responsible for ensuring you have the right to upload any content and that Your Content does not infringe any third-party rights.

6. Data handling and security

Photos uploaded to the Service include metadata such as GPS coordinates, timestamps, and photographer identification. This data is stored securely and is only accessible to authorised users within your company account and anyone you share it with via share links.

We use Supabase (hosted on Amazon Web Services in the EU region) for data storage and authentication, Vercel for application hosting, and Stripe for payment processing. Your data is encrypted in transit (TLS) and at rest.

7. Share links

The Service allows you to generate share links that provide read-only access to job records. You are responsible for managing who receives share links. Share links can be revoked at any time from your dashboard.

Inspector share links include full metadata (timestamps, GPS, trade details). Client share links show a simplified view without trade names or GPS data.

8. Acceptable use

You must not use the Service to store, transmit, or share any content that is unlawful, defamatory, obscene, or infringes the rights of others. You must not attempt to access other users' data, reverse-engineer the Service, or interfere with its operation.

We reserve the right to suspend or terminate your account if we reasonably believe you have breached these Terms.

9. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service is provided “as is” and “as available”. We may experience downtime for maintenance, updates, or circumstances beyond our control.

We are not liable for any loss or damage resulting from service interruptions, data delays, or temporary unavailability.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

You may close your account at any time. Upon account closure, we will delete your data within 30 days, unless we are required by law to retain it.

We may terminate your account with 30 days' written notice. In the event of a material breach of these Terms, we may terminate your account immediately.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
